A foreclosure, as tenant, what are my rights?
We are renting a foreclosure house in California and wanted to know my rights with the current owner. The house has just emerged from pre-foreclosure, eviction notice but hasn't done here yet. The owner House tried to enter through the night without notice and I still have not let him. Has personal and tools in the garage and I think he wants to remove items from the house as the HVAC unit and water heater. Do you have the right to do it while I live here?
Well, your lease is valid and binding you until the foreclosure process is completed, when it canceled its lease. Read your lease and the rights of LL. Check their state LL / right to lease and foreclosure law / protections for tenants. Certainly, it can remove the HVAC and water heater while you are living there and they need air conditioning or hot water. Legally, they probably can not remove the points anyway. Indeed, LL is entitled to withdraw their personal and tools in the shed, but not at night, if these areas are part of your lease, it must give reasonable notice. If the ship is excluded from income that or not included, then he can remove his things each time.
