
What are my options after filing for bankruptcy and your home in foreclosure? Need Help!?
I live in Michigan. I declare Chap.13 bankruptcy and was denied basicially, cause the monthly payment plan, would not leave me with much money to live. Now my house is going into foreclosure. My lawyer suggested that if I keep the house I could afford what I need (about 13,000) and can make further payments. Or could give up my house to the chapter 13 stay here for about 8 months and save my money for the entry of another home. What are my options now? Can I stay here and save some money for 8 months to one year after foreclosure to be expelled out? Are there more options I can use? Thanks for your input.
Do you want to keep your house? If not, sell the house. The last thing a lender wants is to take someone's home. They want to get paid. Enemy contact an agent real estate (get it again because SHARP IS YOUR RIGHT NOW!) to the list or its domestic market. Once you go to court, the lender will have a representation there. Tell the judge that is in the process of selling the house. Take the sales agreement or with luck you can have a signed "purchase offer" you can show the judge your good faith. I have dealt with cases like this a lot. I actually left the closing and gone across the street to the courthouse on behalf of my seller to advise the judge that "we are closing in now." The key is to go to court ….. do not run from it. Good Luck!
